I write in strong opposition to ACA 7. This proposal is nothing but a de facto repeal of California's constitutional guarantee of equal treatment, enshrined in the state constitution via Prop 209 in 1996 and reaffirmed through the recent failure of Prop 16 in 2020.


ACA-7 intends to meaningfully erode and circumvent Prop. 209. Its implementation would undoubtedly lead to racial quotas and preferences, which also violates a series of federal legislation and the U.S. Constitution.


If you still decide to vote for this corrosive proposal against a strong bipartisan consensus against racial preferences, you will:


  1. Alienate the 9.65 million Californians who already rejected Prop 16.
  2. Help waste another $20 million in public funds to campaign for an unconstitutional measure.
  3. Facilitate a barrage of federal lawsuits, which will succeed in shutting down everything you're trying to do. Even your Appropriations staffer seems to know this, based on the legislative analysis issued on August 30th.

Please reject ACA7!
